Precautions for Digital Goods

What should I be careful about when registering digital goods?
From now on, we will go through precautions for creating digital goods.
Please read carefully as they apply for all goods sold at MarppleShop.

Check for font licenses!

There should be many people using fonts when creating an image.
Although some are out for free, the range of use may differ.
Please carefully examine the font license as some fonts cannot be used for commercial purposes.

Images for digital goods must be created or photographed by the creator

You cannot sell goods that used sources from others or imitated a particular brand, product, or character design as they all violate copyrights and design property rights.

Photographs of art, craftwork, product, and brand goods are banned.

You cannot sell photographs of artwork taken from an art museum or brand goods.

Be aware of photographs of public place, public building, and historic site

Can I sell photographs of an architecture or historic site that I took on my trip?
You need to pay special attention when it comes to selling photographs of tourist attractions or landmarks.
Most of these places are highly like to be the possessions of a country, city, corporation, or individual. Selling photographs of them would be a violation of property rights.
Therefore, if you wish to use them, you obtain consent regarding property rights.
Common examples in which you need a consent are as follows.
Photograph that show a company’s name, logo, slogan, address, etc.
Photograph of a historic site’s interior/exterior or recognizable panorama
Photograph of a public place, landmark, or historic site (need to inquire about property rights)
Photograph with a particular landmark (such as 63 Building or Namsan Tower) as the subject
When the photograph only shows a part of the subject, making it unrecognizable,
or when a widely known architecture shows only as a part of a scenery,
you may use it for your goods.
However, it is best to check with relevant departments or people in charge.

You need a consent to portrait rights if a certain person is exposed.

There are many cases in which creators upload photographs of sceneries or figures.
However, you cannot sell goods that contain pictures of others taken accidentally or someone who did not give consent to his or her portrait rights as they are a violation of portrait rights.
If you are trying to sell such images, please obtain consent to portrait rights first!

You cannot sell images that show a company’s name, logo, or label.

If you do not get a consent from a company that owns the property right, MarppleShop rejects sale and may request for evidential materials.

What about images featuring public figures?

If you draw a certain public figure or celebrity,
you cannot make commercial sales if he or she is recognizable.

Other images you cannot sell

As with other goods sold at MarppleShop,
you cannot sell violent, suggestive, or illegal contents.

Please let your customers know!

The copyright of all creator-made contents belongs to creators.
Customers are not buying the commercial rights but only the right to own the images personally.
Therefore, you cannot commercially sell the image that you purchased in other places. If you do, it is a clear violation of copyrights.
Moreover, you cannot distribute the purchased image to others or transfer/give membership to others.
It is good to tell your customers that they cannot use the purchased image commercially through a separate instruction.
